Terms of Service

These terms govern your use of EduBulk SMS Services ("EduBulk", "we", "us"), a bulk SMS platform operated by [Eduscape Systems — registered legal name, registration number, address]. By creating an account you agree to them on behalf of yourself and the organisation you represent.

1. The service

EduBulk lets organisations import contacts, send and schedule SMS messages, view delivery reports and integrate through an API. Messages are delivered through third-party mobile network operators and SMS gateways; we do not control those networks and cannot guarantee delivery or delivery time.

2. Your account

• You must give accurate information and keep your password and API keys secret. You are responsible for all activity under your account.
• You must be authorised to act for your organisation.

3. Consent and acceptable use

You may message only people who have given you their permission to receive messages from you, or with whom you have an existing relationship for the purpose of the message (for example parents of enrolled pupils, or patients with appointments). You must not:

• send spam, unsolicited marketing, or messages to purchased or scraped lists;
• send unlawful, fraudulent, threatening, defamatory or misleading content, or messages impersonating another person or organisation;
• use a Sender ID you are not entitled to use;
• ignore opt-out requests. Anyone who opts out (via our opt-out page or by asking you) must not be messaged again;
• attempt to disrupt the service, bypass credit limits or security, or resell the service without our written agreement.

We may suspend or terminate accounts, hold messages, or report activity to authorities where we reasonably believe these rules or the law are being broken.

4. Opt-out

We provide a public opt-out page at edubulksms.eduscapesystems.com/o. When someone opts out, we stop sending them messages from the organisations that have texted them. You should include the opt-out line offered in the compose screen on marketing and other non-essential messages.

5. Credits and payment

• Messages are paid for with prepaid credits. One credit covers one SMS segment (160 characters, or 70 with non-Latin characters; longer messages use several segments).
• Credits are deducted when a message is queued. Credits for messages that fail to send, are rejected by the network, or are cancelled before sending are returned to your balance.
• Purchased credits are otherwise non-refundable and do not entitle you to cash. Prices are shown in Ugandan shillings and may change for future purchases. [Add expiry policy if any.]
• Payments are processed by third-party payment providers (mobile money and cards). We do not store your card or mobile money PIN.

6. Sender IDs

Custom Sender IDs must be approved before use and depend on network rules. Approval can take time and may be refused. Until a Sender ID is approved, messages may be sent under a default sender.

7. Your data

You own your contact lists and message content. You confirm that you have the right to upload and message the contacts you add. How we handle personal data is described in our Privacy Policy.

8. Availability and liability

We work to keep the service running but provide it "as is". To the extent the law allows, we are not liable for delayed or undelivered messages caused by networks, gateways, device settings or events outside our control, or for indirect or consequential loss. Our total liability for any claim is limited to the amount you paid us in the three months before the claim. Nothing in these terms excludes liability that cannot be excluded by law.

9. Ending the agreement

You may stop using the service at any time. We may suspend or end your account for breach of these terms. Unused credits on an account closed for breach are forfeited.

10. Changes and governing law

We may update these terms and will post the new version here; continued use means you accept it. These terms are governed by the laws of Uganda, and the courts of Uganda have jurisdiction.
